Terms of use

These Terms of Use (“Terms”) govern your access to and use of the VideoSaver mobile application (the “App”), provided by Dhara Apps (“we,” “us,” or “our”).

By downloading, installing, accessing, or using VideoSaver, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. About VideoSaver

VideoSaver is an iOS application that allows users to download, import, save, edit, process, and share video and audio content using various tools, including features such as:

• Downloading videos from supported links
• Importing media from the device or photo library
• Saving content to Photos
• Sharing content through iOS share options
• Editing tools such as trim, split, crop, merge, compress, effects, music extraction, and MP3 export
• Optional premium features available through subscription

We may update, modify, suspend, or discontinue any part of the App at any time, with or without notice.

2. Eligibility

You must be at least 13 years old, or the minimum age required by law in your country, to use VideoSaver.

If you are under the age of majority in your jurisdiction, you may use the App only with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

By using the App, you represent that you meet these eligibility requirements.

3. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use VideoSaver on Apple devices that you own or control, solely for your personal, non-commercial use, unless otherwise permitted by applicable law.

You may not:

• Copy, modify, distribute, sell, lease, or sublicense the App
• Reverse engineer, decompile, or attempt to extract the source code of the App, except where permitted by law
• Use the App for unlawful, harmful, fraudulent, or abusive purposes
• Interfere with or disrupt the App, servers, or networks connected to the App
• Use automated systems, bots, or scripts to access or misuse the App
• Remove or alter any copyright, trademark, or proprietary notices

All rights not expressly granted to you are reserved by us and our licensors.

4. User Responsibilities

You are solely responsible for your use of VideoSaver and for any content you download, import, edit, save, share, or distribute through the App.

You agree that you will:

• Use the App only in compliance with these Terms and all applicable laws
• Obtain all necessary rights, permissions, and consents before downloading, copying, editing, or sharing any content
• Respect copyright, trademark, privacy, and intellectual property rights of others
• Comply with the terms and policies of third-party platforms from which content may originate
• Use the App only for lawful personal purposes

You agree that you will not use VideoSaver to:

• Download, reproduce, or distribute copyrighted content without authorization
• Violate the rights of creators, platforms, or other users
• Upload, process, or share illegal, harmful, abusive, defamatory, or infringing content
• Circumvent technical protections or platform restrictions unlawfully
• Use the App in a way that could damage our reputation or expose us to legal liability

We do not monitor all user activity, but we reserve the right to investigate and take action if we believe you have violated these Terms.

5. Content and Copyright

VideoSaver is a tool that helps you manage and process media. We do not claim ownership over videos, audio files, images, or other content that you import, download, edit, or create using the App.

You retain responsibility for all content you access or process through VideoSaver.

You acknowledge and agree that:

• Not all online content may be legally downloadable or reusable
• You must ensure you have the legal right to use any content you process with the App
• We are not responsible for how you use downloaded or edited content
• We do not guarantee that any specific link, platform, or media source will always be supported

6. Third-Party Services and Platforms

VideoSaver may interact with third-party services, platforms, websites, or APIs, including social media platforms, media hosting services, Apple services, and subscription management providers.

We do not control and are not responsible for third-party services, including their:

• Availability
• Content
• Policies
• Functionality
• Security practices

Your use of third-party services is governed by their own terms and privacy policies. Any relationship you have with those third parties is solely between you and them.

7. Subscriptions and Premium Features

VideoSaver may offer optional premium features through auto-renewable subscriptions or other in-app purchases processed by Apple App Store.

7.1 Subscription Terms

If you purchase a subscription:

• Payment will be charged to your Apple ID account
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel subscriptions in your Apple ID account settings
• Any free trial, if offered, may convert to a paid subscription unless canceled before the trial ends

7.2 Pricing and Changes

Subscription prices, trial offers, and available plans may vary by region and may change from time to time. Any applicable price changes will be handled according to Apple’s App Store policies.

7.3 Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple in accordance with Apple’s refund policies. We do not directly process App Store payments or refunds.

7.4 Premium Access

Premium features are available only while your subscription is active and valid. We may modify, add, or remove premium features at any time.

8. Device Permissions and Local Storage

To provide its features, VideoSaver may request access to certain device functions, such as:

• Photo library access for importing or saving media
• Internet access for downloads and subscription validation
• Background processing for downloads and related tasks

You may manage permissions through your device settings. If you disable required permissions, some features may not function properly.

Much of your content and app data is stored locally on your device. You are responsible for maintaining backups and managing storage on your device.

9. Privacy

Your use of VideoSaver is also governed by our Privacy Policy, which explains how we collect, use, and protect information.

By using the App, you acknowledge that you have read and understood our Privacy Policy.

10. Intellectual Property

The App, including its design, software, code, branding, logos, graphics, text, and related materials, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

These Terms do not grant you any ownership rights in VideoSaver or its content, except for the limited license expressly provided above.

“VideoSaver” and related branding may not be used without our prior written permission.

11. App Availability and Updates

We strive to keep VideoSaver reliable and useful, but we do not guarantee that the App will always be:

• Available
• Uninterrupted
• Error-free
• Compatible with every device or iOS version
• Able to support every link, platform, or file format

We may release updates, bug fixes, or feature changes at any time. Some updates may be required for continued use of the App.

We are not liable for any loss or inconvenience caused by downtime, maintenance, updates, or service interruptions.

12. Disclaimer of Warranties

To the fullest extent permitted by applicable law, VideoSaver is provided on an “AS IS” and “AS AVAILABLE” basis.

We disclaim all warranties of any kind, whether express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy
• Reliability
• Availability

We do not warrant that:

• The App will meet your requirements
• Downloads will always succeed
• Content will always be available from third-party sources
• Edited or exported files will always meet your expectations
• The App will be free from bugs, viruses, or security vulnerabilities

You use the App at your own risk.

13. Limitation of Liability

To the fullest extent permitted by law, Dhara Apps and its owners, developers, affiliates, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:

• Loss of data
• Loss of profits
• Loss of content
• Device damage
• Business interruption
• Unauthorized access
• Legal claims arising from your use of third-party content

To the extent permitted by law, our total liability for any claim arising out of or relating to the App or these Terms shall not exceed the greater of:

• The amount you paid to us for the App or subscription in the 12 months before the claim, or
• USD $50

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Dhara Apps and its owners, developers, affiliates, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the App
• Your violation of these Terms
• Your violation of any law or third-party rights
• Content you download, import, edit, save, or share through the App

15. Termination

We may suspend or terminate your access to VideoSaver at any time, with or without notice, if we reasonably believe you have violated these Terms or used the App unlawfully.

You may stop using the App at any time by uninstalling it from your device.

Upon termination:

• Your license to use the App ends immediately
• You must cease all use of the App
• Sections that by their nature should survive termination will remain in effect, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law

16. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the “Last updated” date at the top of this page. If changes are material, we may provide additional notice within the App or on our website.

Your continued use of VideoSaver after updated Terms become effective constitutes your acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction in which Dhara Apps operates, without regard to conflict of law principles.

If you are a consumer in a country that requires local mandatory consumer protection laws to apply, those laws may also apply to the extent required.

18. Dispute Resolution

Before filing a formal legal claim, you agree to contact us first at dhara.divakar.apps@gmail.com and attempt to resolve the issue informally.

If a dispute cannot be resolved informally, it shall be handled in accordance with applicable law and the competent courts or dispute resolution mechanisms of the relevant jurisdiction, unless otherwise required by mandatory consumer protection laws in your country.

19. Apple-Specific Terms

If you downloaded VideoSaver from the Apple App Store, you also acknowledge and agree that:

• These Terms are between you and Dhara Apps, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for addressing claims relating to the App, including product liability, legal compliance, or consumer protection claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

Your use of the App must also comply with Apple’s applicable App Store terms and policies.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms presented within the App, constitute the entire agreement between you and Dhara Apps regarding your use of VideoSaver.
